By accessing or using the Blackhawk Outfitters Ltd. website ("Website"), purchasing products, or conducting firearm transfers at our facility, you agree to be bound by these Terms of Service ("Terms").

These Terms constitute a legally binding agreement between you and Blackhawk Outfitters Ltd., a Colorado limited liability company and federally licensed firearms dealer (FFL: 5-84-035-01-9A-17323). If you do not agree to these Terms, you may not use our Website or services.

Federal law (18 U.S.C. § 922) and Colorado law govern all age requirements for firearm and ammunition purchases.

• 21 years old minimum: Required to purchase non-firearm products (outdoor gear, accessories)
• 21 years old minimum: Required to purchase rifles and shotguns from a licensed dealer (Colorado law)
• 21 years old minimum: Required to purchase handguns and handgun ammunition

By placing an order, you represent and warrant that you meet all applicable age requirements for the items you are purchasing.

3.1 Background Check Requirement

All firearm purchases require completion of ATF Form 4473 (Firearms Transaction Record) and successful completion of a background check through the Colorado Bureau of Investigation (CBI) InstaCheck system. A $15 state fee applies, paid by the purchaser at time of transfer.

3.2 Colorado Waiting Period

Colorado law (C.R.S. § 18-12-115) requires a minimum 3-day waiting period between the initiation of a background check and the transfer of a firearm. This period cannot be waived under any circumstances.

3.3 Prohibited Persons

Under 18 U.S.C. § 922(g), the following persons are prohibited from purchasing or possessing firearms:

• Persons convicted of a crime punishable by imprisonment for more than one year
• Fugitives from justice
• Unlawful users of or addicted to controlled substances
• Persons adjudicated as mental defective or committed to a mental institution
• Illegal aliens or non-immigrant visa holders (with limited exceptions)
• Persons dishonorably discharged from the Armed Forces
• Persons subject to certain domestic violence restraining orders
• Persons convicted of a misdemeanor crime of domestic violence

If your background check is denied, the sale cannot proceed. You may appeal a denial through the FBI NICS Section at (304) 925-4829 or the Colorado Bureau of Investigation at (303) 239-8062. We are not responsible for delays or denials in the background check process.

We provide FFL transfer services for firearms purchased from other dealers. Transfer fees, requirements, and procedures are detailed on our FFL Transfer page. All transfers are subject to the same background check and 3-day waiting period requirements as direct purchases. Storage fees apply after 30 days.

Shipping policies, rates, and restrictions are detailed on our Shipping Information page. By placing an order, you agree to:

• Provide accurate shipping information
• Comply with all applicable shipping restrictions for your state
• Accept that firearms can only be shipped to licensed FFL dealers
• Accept that certain items cannot be shipped to restricted states

Our return policy is detailed on our Returns & Exchanges page. Key points:

• Non-firearm items: 14-day return window for unopened, unused items in original packaging
• Firearms: Final sale once ATF Form 4473 has been initiated (federal law requirement)
• Ammunition: Cannot be returned under any circumstances due to safety regulations

All prices are listed in U.S. Dollars. We reserve the right to modify prices at any time without notice. Prices are not finalized until your order is confirmed. We are not responsible for typographical errors in pricing.

Payment is processed via GunTab, our compliant firearms payment processor. GunTab transaction fees (2.5% + fixed fee) are paid by the buyer, consistent with firearms industry payment processing requirements. Payment must be received in full before items are shipped or transferred.

Certain products may not be available for purchase or shipment to all states due to state and local laws. It is your responsibility to know the laws in your jurisdiction. We reserve the right to cancel any order that would violate applicable law. Common restrictions include magazine capacity limits (Colorado: 15 rounds, C.R.S. § 18-12-302), specific firearm models, and ammunition types.

To the maximum extent permitted by law, Blackhawk Outfitters Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Website or products. Our total liability shall not exceed the amount you paid for the specific product or service giving rise to the claim.

You agree to indemnify and hold harmless Blackhawk Outfitters Ltd. from any claims, damages, or expenses arising from your violation of these Terms, misuse of products, or violation of any applicable law.

Any disputes arising from these Terms or your use of our services shall be governed by the laws of the State of Colorado. You agree to submit to the exclusive jurisdiction of the courts located in Denver County, Colorado. Before filing any legal action, you agree to attempt good-faith negotiation for at least 30 days.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our Website. Your continued use of our Website or services after changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
