1. Introduction

Blackhawk Outfitters Ltd. ("Company," "we," "us," or "our") operates as a federally licensed firearms dealer (FFL: 5-84-035-01-9A-17323) and operates the website blackhawkltd.com. This Privacy Policy explains how we collect, use, disclose, and protect your personal information.

As an FFL dealer, we are subject to federal regulations governing firearms records (18 U.S.C. § 923(g); 27 CFR § 478.124–478.129) that impose mandatory record-keeping obligations beyond typical e-commerce privacy practices. This policy addresses both our commercial data practices and our federally mandated record-keeping obligations.

By using our Website or purchasing products, you consent to the practices described in this Privacy Policy. If you do not agree, please do not use our Website or services.

2. Information We Collect

Information You Provide

  • Identity information: Full legal name, date of birth, government-issued ID details (required for firearm transactions per 27 CFR § 478.124)
  • Contact information: Email address, phone number, mailing/shipping address
  • Transaction information: Purchase history, payment method (processed by GunTab — we do not store full card numbers)
  • ATF Form 4473 data: All information required by federal law for firearm transfers (see Section 3)
  • FFL transfer information: For incoming transfers, your dealer's FFL information and firearm details

Information Collected Automatically

  • IP address, browser type and version, operating system
  • Pages visited, time spent, referring URL
  • Cookie data (see Section 9)
  • Google Analytics 4 data (measurement ID: G-ZXQ9MLH2CN)
3. ATF Record Requirements

Federal Law Notice: As a licensed FFL dealer, we are required by federal law (18 U.S.C. § 923(g) and 27 CFR § 478.129) to retain ATF Form 4473 and all associated records for a minimum of 20 years. These records may be accessed by ATF during compliance inspections.

ATF Form 4473 records include: buyer's full legal name, date of birth, place of birth, current residence address, height/weight, ethnicity, sex, U.S. citizenship status, and all answers to the federal eligibility questionnaire. These records are retained separately from our commercial customer database and are governed exclusively by federal firearms law.

Background check data submitted to the Colorado Bureau of Investigation (CBI) InstaCheck program is governed by Colorado law (C.R.S. § 24-33.5-424). CBI retains approved transaction records per state law; denied records are retained for appeals purposes.

5. Sharing Your Information

We do not sell your personal information. We share information only in the following circumstances:

Required by Law

ATF Form 4473 records are subject to inspection by Bureau of Alcohol, Tobacco, Firearms and Explosives agents. Background check information is transmitted to the Colorado Bureau of Investigation as required by state law. We may also disclose information in response to valid legal process (subpoenas, court orders).

Service Providers

  • GunTab: Payment processing. GunTab processes card payments and is subject to PCI DSS compliance. We do not store full card numbers.
  • Shipping carriers: USPS, FedEx, UPS — name and shipping address for delivery
  • Google Analytics: Anonymized website analytics. You may opt out via Google's opt-out browser add-on.
  • Suppliers: Order fulfillment only — name and shipping address for drop-ship orders

Business Transfers

In the event of a merger, acquisition, or sale of assets, customer information may be transferred. ATF records transfer obligations are governed by 27 CFR § 478.127 (out-of-business records requirements).

6. Data Security

We implement reasonable technical and organizational security measures to protect your personal information, including SSL/TLS encryption for data in transit, access controls limiting who can access customer data, and secure storage for ATF records.

No method of internet transmission or electronic storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security. ATF firearms records are maintained with heightened security measures given their regulatory significance.

7. Colorado Privacy Rights (CPA)

The Colorado Privacy Act (CPA), effective July 1, 2023 (C.R.S. § 6-1-1301 et seq.), grants Colorado residents the following rights regarding their personal data:

  • Right to Access: Request a copy of the personal data we hold about you
  • Right to Correction: Request correction of inaccurate personal data
  • Right to Deletion: Request deletion of your personal data (subject to federal retention requirements — ATF records cannot be deleted)
  • Right to Portability: Receive your data in a portable format
  • Right to Opt Out: Opt out of targeted advertising and sale of personal data

Important Limitation: ATF Form 4473 records and related firearms transaction records cannot be deleted or modified per federal law (27 CFR § 478.129), regardless of state privacy law requests. These records are federally mandated and outside the scope of state privacy rights.

8. California Residents (CCPA)

California residents have additional rights under the California Consumer Privacy Act (CCPA / CPRA). We do not sell California residents' personal information. California residents may request disclosure of personal information collected, deletion of personal information (subject to ATF record retention requirements), and opt out of sharing for cross-context behavioral advertising.
